Open Question: When can you legally use pepper spray in California (Los Angeles)?

When is it legal to use pepper spray on someone and not get arrested yourself? If someone is swinging punches at you, but does not hit you, can you pepper spray them? or do they have to actually hit you first?? What if they are in your face and threatening to kill you or beat you? Is it legal then?

Open Question: Need help with motion to dismiss judgement please?

To make a long story short, my mother's wages are being garnished because of a judgement against her, but she was never properly subpoenaed. The lawyers office that was trying to sue her did not have her correct address, so we could never fight the case or settle with them. I was told I can file a motion to dismiss the judgement and they would have to start the process all over again (My mom is willing to settle, but she wants it off her credit report). The lawyers office does not believe that they had the wrong address and are being very difficult to deal with. I was trying to find the correct document, but I could not find it. Its for a California court, to be more specific, Los Angeles if it makes any difference. Does anyone know which form it is? And what option or what boxes would I check on the form for this type of case? Thanks for your time :-)
